About these terms
These terms apply to your use of samedaycourierskent.co.uk and to enquiries and bookings made with Same Day Couriers Kent, a trading name of Astute Management, Alva House, Valley Drive, Gravesend, Kent DA12 5UE (‘we’, ‘us’, ‘our’). By using the site or booking a delivery with us, you agree to these terms.
A separate set of conditions of carriage may apply to confirmed bookings. If they do, we will give them to you before we confirm the booking, and where they differ from these terms, the conditions of carriage apply to that booking.
Using our website
The information on this website is general information about our services. We keep it accurate and up to date as far as we reasonably can, but it is not an offer to carry any particular job at any particular price. We may change or withdraw the site, or any part of it, at any time, and we do not guarantee it will always be available or free from errors.
You must not misuse the site. That includes trying to gain unauthorised access to it, introducing viruses or other harmful code, interfering with how it works, or submitting false or misleading enquiries.
Our service
Same Day Couriers Kent provides same-day courier deliveries, mainly for businesses. We collect from across Kent and arrange delivery anywhere in the UK. Individuals may also contact us through the website.
When is a booking confirmed?
Sending an enquiry through our website, by email or by any other means is not a confirmed booking. A booking is confirmed only when we have confirmed to you the vehicle, the collection time, the price and the goods-in-transit cover that applies. The price and payment terms are confirmed at booking.
Our quotes are based on the information you give us. If the goods, addresses, timings or access arrangements turn out to be different, we may need to change the vehicle, the collection time or the price. Where we can, we will tell you before we go ahead.
Who carries out your delivery?
Same Day Couriers Kent has its own vehicles and a network of drivers based throughout Kent. We also work with trusted partner couriers across Kent and other parts of the country. Vehicles across our network range from mopeds and motorcycles through small cars, cars and vans to lorries.
Your job may be carried out by one of our own drivers or by one of our trusted partner couriers working on our behalf. Either way, Same Day Couriers Kent is the business you book with and your point of contact for the job.
Your responsibilities
When you book with us, you agree to:
- give us accurate and complete details, including addresses, contact names, collection and delivery times, and the size, weight and nature of the goods
- package and label the goods so they can be handled and carried safely, suitable for their nature and the journey
- make sure the goods are lawful to own and to transport, and that you are entitled to send them
- declare any dangerous goods at the time of booking, and make sure they are classified, packed and labelled as the law requires
- for diagnostic specimens (UN3373), pack them to packing instruction P650 and mark them correctly before collection, and declare any dry ice or Category A infectious substances when you enquire
- declare any high-value items at the time of booking, so we can confirm whether and how they can be carried and what cover applies
- make sure the goods are ready at the agreed collection time and that someone is available to receive them at delivery
- make sure you are entitled to give us the personal details of the people at the collection and delivery points
Prohibited and restricted items
We will not carry anything that is illegal to possess or transport, anything you are not entitled to send, or anything packed in a way that could put people, vehicles or other property at risk.
Some items can only be carried if we have agreed in advance, at the time of booking. These include dangerous goods, diagnostic and medical specimens, cash and other high-value items such as jewellery and precious metals, perishable goods that need temperature control, and live animals. We may refuse any item, or stop carrying it, if we reasonably believe it is prohibited, has not been properly declared, or is unsafe to carry.
Goods-in-transit cover and our liability for goods
Every consignment includes goods-in-transit cover of up to £100 as standard. Any limit on our liability for loss of or damage to the goods will be confirmed to you before we confirm your booking.
Additional insurance is not automatically included in our standard quotation. If your goods are worth more than £100, tell us when you submit your enquiry and give their approximate value. Where additional cover can be arranged, we will confirm the level of cover and any additional cost before you accept the booking. If it cannot be arranged, we will tell you, so you can decide whether to go ahead or arrange your own insurance.
For valuable, fragile, unusual or specialist items, please give us as much information as possible when you request a quotation, so we can make the right arrangements.
If goods are lost or damaged, please tell us in writing as soon as possible, giving the job details and a description of the loss or damage, and keep the goods and packaging for inspection where you can.
Delays outside our control
We will do everything we reasonably can to collect and deliver at the times agreed. Some things are outside our reasonable control, including accidents, unplanned road closures, exceptional traffic congestion, severe weather, actions of the police or other authorities, and delays at the collection or delivery point. We are not responsible for delays caused by events like these, but we will keep you informed and do what we reasonably can to reduce their effect.
If a delivery cannot be completed, for example because nobody is available to receive the goods or the site is closed, we will contact you to agree what happens next. Any extra cost will be agreed with you.
Cancellations and changes
Cancellation terms, including any charges, are agreed at the time of booking. If you need to cancel or change a booking, please tell us as soon as possible.
Complaints
If you are unhappy with our service, please email hello@samedaycourierskent.co.uk with the job details and tell us what went wrong, and we will look into it.
Intellectual property
The content of this website, including its text, design, logos and images, belongs to us or is used with permission. You may view and print it for your own use, but you may not copy, reproduce or use it for commercial purposes without our written permission.
Links to other websites
Our website may link to websites run by other people. We do not control those websites and are not responsible for their content, availability or how they use your data.
Limitation of liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law.
Subject to that:
- our liability for loss of or damage to goods is limited to the amount we confirmed to you before your booking was confirmed
- for business customers, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, production or contracts, however it arises
- we are not liable for any loss that arises from relying on the general information on this website
If you use our services as a consumer rather than a business, nothing in these terms affects your statutory rights.
Your personal data
We use personal data as set out in our Privacy Policy.
Changes to these terms
We may update these terms from time to time. The version on this page when a booking is confirmed applies to that booking.
Governing law
These terms, and any dispute arising from them, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
